USERS STILL STUCK IN THE MUD An analysis of Meta’s 2026 changes to its consent-for-ads mechanism against EU law
This BEUC report examines Meta's January 2026 revisions to its pay-or-consent advertising flow and assesses compliance with EU law, notably the Digital Markets Act, the GDPR and the Unfair Commercial Practices Directive. It finds that although some improvements were made, key problems remain: the less personalised ads option is not presented neutrally or upfront, interface design and wording bias users toward personalised ads, and the less personalised alternative entails degraded service. BEUC calls on the European Commission, consumer protection authorities and data protection authorities to enforce compliance.
